Drivers under 18 shall not use a cellular or mobile telephone or other mobile electronic device, whether hands-free or not, while driving or while temporarily stopped in traffic. The only exception is reporting an emergency to the enhanced 911 system or a public safety agency. Adults over 18 may use a hands-free device under RSA 265:79-c, which is why hands-free feels permitted, but that allowance does not extend to minors. Being stopped at a light or having a parent aboard changes nothing.
